First topic message reminder :

If you have enough money to need a pre-nuptual agreement then why get married anyway ??? It's a joke..........

"Honey you're the stars in the sky.........You're the flowers on a rose.........You're the fuel that keeps my engine running........Will you marry me!!!"

"But on the off chance you're a Cow sign this!!!".........

Marriage is a joke these days .....I don't see the point.......Live together and be happy.....It's only a piece of paper.....Doesn't make you feel any different.........

If you have to sign pre-nuptuals then he/she is obviously a money-grabbing swine and has doubts about you anyway.........

Throw caution to the wind and go with the flow...............Or just stay single and happy............

All or nothing..........

Also it is not a little bit of wiggle room for judges to use discretion as you put it. It is about whether the courts think applying the prenup would in the situation be fair. The courts have a lot of factors to look at to decide if it is fair or not such as frame of mind, children, length of marriage, knowledge of the other parties wealth, was legal advice sought, did one party act under duress etc etc etc

In the case you quoted the court found it was fair to apply the prenup and one of the reasons was because the wife was German, the husband was French and the prenup was created and signed in Germany where prenuptial law is valid and enforceable.

Would it be fair for the prenup which was created and agreed to in Germany where prenups are enforceable to be overridden because the divorce happened in the uk? The courts obviously found that it wouldn't be fair.
