Um, yes duty that's what the penalty was for. And then Picamoles punched him in the face which supersedes his offence.

McCaw should have been binned for a combination of:
a) Coming up the side of the maul (initial penalty)
b) Lying on the wrong side of the ruck
c) Lying on top of the ball to prevent the French taking a quick tap penalty
All in his own 22 as well.

(a) Punching or striking. A player must not strike an opponent with the fist or arm, including the elbow, shoulder, head or knee(s).
Seems extremely obvious that Picamoles actions involved striking McCaw in the face with his fist. You have to be pretty blinkered to objet to a yellow for that.
